These Terms of Service, also referred to as the “Terms,” govern your access to and use of PeritoUrology.com and any webpages, forms, content, features, or online services that link to these Terms collectively, the “Website.”

The Website is operated by Paul E. Perito, M.D., P.A., doing business as Perito Urology (“Perito Urology,” “we,” “us,” or “our”).

By accessing or using the Website, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website.

1. Website Information Is Not Medical Advice

The Website provides general information concerning urology, men’s health, sexual health, medical conditions, surgical procedures, nonsurgical procedures, medical devices, recovery, patient experiences, and related subjects.

Website content is provided for general educational and informational purposes only. It is not intended to be, and should not be interpreted as:

• Medical advice.
• A diagnosis or treatment recommendation.
• A substitute for an examination by a qualified healthcare professional.
• A substitute for professional medical judgment.
• A guarantee that any treatment or procedure is appropriate for you.
• A guarantee that any particular outcome will occur.

Do not rely on a Website submission, email, voicemail, or appointment request to communicate an emergency. Perito Urology does not guarantee that Website submissions or electronic communications will be reviewed within any particular period.

Current patients experiencing an urgent postoperative or treatment-related concern should follow the instructions provided by their treating healthcare professional or contact the office using the appropriate clinical contact method.

3. No Doctor–Patient Relationship Through Website Use

Accessing the Website, viewing its content, submitting a general contact form, requesting an appointment, downloading materials, subscribing to a newsletter, or sending an email does not by itself create a doctor–patient relationship between you and Perito Urology or any physician or healthcare professional associated with the practice.

A doctor–patient relationship is established only after Perito Urology has accepted you as a patient and the appropriate clinical evaluation, registration, consent, and other required processes have been completed.

Perito Urology is not obligated to accept any person as a patient. We may decline, cancel, or refer a prospective patient when clinically, legally, operationally, or professionally appropriate.

4. Appointments and Consultation Requests

The Website may allow you to request an appointment, consultation, telehealth visit, or other service.

Submitting a request does not mean that:

• An appointment has been scheduled or confirmed.
• A physician has agreed to evaluate or treat you.
• A requested date or time is available.
• A requested procedure is medically appropriate.
• Insurance coverage has been verified.
• A quoted or estimated price is final.
• Travel arrangements should be made.

An appointment is confirmed only when Perito Urology communicates confirmation to you.

Do not purchase airline tickets, reserve lodging, discontinue medication, arrange medical leave, or make other significant plans until the office has confirmed the relevant appointment or procedure and provided appropriate instructions.

We may reschedule or cancel appointments because of clinical needs, emergencies, physician availability, facility requirements, weather, equipment issues, incomplete documentation, payment requirements, or other circumstances.

5. Telehealth Services

The Website may provide information about or facilitate requests for telehealth appointments.

Telehealth availability depends on factors that may include:

• The patient’s physical location at the time of the appointment.
• The healthcare professional’s licensing and legal authority.
• The nature of the patient’s condition.
• Whether an in-person physical examination is necessary.
• The technical suitability of the available platform.
• Applicable federal and state laws.
• Clinical judgment and patient-safety considerations.

Requesting a telehealth appointment does not guarantee that Perito Urology can provide telehealth services in your location.

You may be required to verify your identity and physical location at the beginning of a telehealth visit. Perito Urology may require an in-person appointment before making a diagnosis, prescribing medication, recommending surgery, or providing another service.

Telehealth has technological and clinical limitations. Connections may fail, communications may be interrupted, image or audio quality may be inadequate, and some conditions cannot be appropriately evaluated remotely.

Additional telehealth consent terms may be presented before an appointment. Those terms control with respect to the telehealth service itself.

6. Patient Forms and Electronic Submissions

The Website may provide patient-registration, medical-history, insurance, authorization, consent, medical-record-release, and other healthcare forms.

You agree that information submitted through these forms will be accurate, current, and complete to the best of your knowledge.

You must not knowingly:

• Provide false or misleading information.
• Submit information while impersonating another person.
• Alter another person’s medical or insurance information without authority.
• Submit a form for another adult without legal authorization.
• Upload malicious, unlawful, or unrelated files.
• Attempt to access another person’s form submission or patient information.

Submitting a patient form does not guarantee acceptance as a patient, approval for treatment, insurance coverage, or the scheduling of a procedure.

Electronic signatures, checkboxes, typed names, date-and-time records, and similar electronic actions may be treated as your signature or acknowledgment where permitted by law.

Some clinical or legal documents may require additional verification, witnessing, identity confirmation, or an in-person signature. Perito Urology may require you to complete or sign a document again.

7. Separate Clinical and Financial Agreements

These Terms govern use of the Website. They do not replace any:

• Informed-consent document.
• Procedure-specific consent.
• Telehealth consent.
• Notice of Privacy Practices.
• Financial policy.
• Insurance assignment.
• Payment agreement.
• Concierge-services agreement.
• Medical-record authorization.
• Surgical-center agreement.
• Hospital agreement.
• Medical-device warranty.
• Treatment plan.
• Postoperative instruction.
• Other patient or clinical document.

If these Terms conflict with a signed clinical, consent, payment, or patient-care agreement concerning medical services, the more specific agreement controls with respect to those services.

Nothing in these Terms limits any professional duty owed by a healthcare professional to an established patient or any right that cannot lawfully be waived.

8. Insurance, Pricing, and Payment Information

Website statements concerning insurance, procedure costs, financing, reimbursement, concierge fees, warranties, or payment are general information unless expressly identified as a binding written offer.

Insurance coverage depends on the patient’s plan, medical necessity requirements, exclusions, deductibles, coinsurance, authorization requirements, network status, and the insurer’s final determination.

Verification of benefits is not a guarantee of payment. Patients remain responsible for amounts not paid by an insurer unless otherwise required by law or agreed to in writing.

Prices and estimates may change based on the evaluation, services performed, facility, anesthesia, implants, medical devices, laboratory testing, medications, complications, revisions, travel arrangements, and other factors.

Final financial obligations are governed by the applicable financial documents provided to the patient.

9. Travel and Concierge Information

The Website may provide information or assistance concerning hotels, transportation, travel, concierge services, or services offered by third parties.

Unless expressly stated in a separate written agreement, Perito Urology:

• Does not operate third-party hotels, airlines, transportation companies, restaurants, travel agencies, or other outside businesses.
• Does not guarantee third-party availability, pricing, quality, accessibility, safety, or performance.
• Is not responsible for travel delays, cancellations, lost property, weather, immigration issues, passport requirements, or third-party actions.
• Is not responsible for a patient’s decision to travel before receiving medical or scheduling clearance.

Patients are responsible for confirming travel requirements and purchasing any desired travel insurance.

Medical clearance to travel may depend on the procedure, individual recovery, complications, and the treating physician’s judgment.

10. Outcomes, Testimonials, and Before-and-After Content

Medical and aesthetic outcomes vary from person to person.

Outcomes may depend on age, anatomy, health, medical history, medications, adherence to instructions, prior procedures, healing, complications, device selection, lifestyle, and other factors.

Testimonials, reviews, case descriptions, photographs, videos, and before-and-after materials reflect individual experiences. They do not establish what every patient should expect and do not guarantee that another patient will receive the same or similar outcome.

Photographs and videos may be cropped, resized, reformatted, or adjusted for clarity or presentation. They should not be used as the sole basis for a treatment decision.

A qualified healthcare professional must evaluate whether a procedure is appropriate for a particular patient and explain its reasonably foreseeable risks, benefits, alternatives, and limitations.

11. Medical Devices and Third-Party Products

The Website may discuss medical devices, implants, medications, injectables, equipment, manufacturers, or other third-party products.

Product names and trademarks belong to their respective owners.

Discussion of a product does not necessarily constitute:

• A warranty by Perito Urology.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

15. User Communications and Submissions

You remain responsible for information and materials that you submit through the Website.

Do not submit content that is unlawful, threatening, defamatory, infringing, deceptive, malicious, obscene, or unrelated to the purpose of the relevant form.

Except for protected health information and other information governed by our Privacy Policy or Notice of Privacy Practices, you grant Perito Urology permission to use a submission as reasonably necessary to:

Perito Urology, The Perito Implant®, UroFill®, associated logos, and other names or marks displayed on the Website may be trademarks or service marks of Perito Urology or their respective owners.

No trademark license is granted by these Terms.

You may print or download a reasonable number of pages for your personal, noncommercial use, provided that you do not alter the materials or remove proprietary notices.

Permission is required for commercial reproduction, republication, broadcasting, training, presentation, redistribution, or other use.

17. Third-Party Websites and Services

The Website may link to or embed content from third parties, including video platforms, social networks, manufacturers, medical organizations, payment services, travel providers, and other websites.

A link or embedded feature does not mean that Perito Urology controls or assumes responsibility for the third party.

Use of the Website is also governed by our Privacy Policy.

Do not submit sensitive medical information through a general contact or newsletter form when a designated patient form or other secure process is available.

19. Website Availability and Changes

We may modify, suspend, restrict, or discontinue any part of the Website at any time.

We do not guarantee that:

• Website content will be error-free or current.
• Every feature will work with every browser or device.
• A submission will be successfully transmitted or received.

To the fullest extent permitted by law, Perito Urology and its owners, physicians, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

• Inability to access the Website.
• Reliance on general Website information.
• Loss or corruption of a Website submission.
• Third-party websites or services.
• Unauthorized access caused by circumstances outside our reasonable control.
• Decisions made before an appointment or treatment relationship has been established.

Nothing in these Terms excludes or limits liability for medical malpractice, professional negligence, fraud, willful misconduct, or another matter that cannot lawfully be excluded or limited.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Perito Urology and its owners, physicians, employees, contractors, and service providers from claims, damages, liabilities, judgments, and reasonable costs arising from:

• Your material violation of these Terms.
• Content you submit in violation of another person’s rights.
• Fraudulent, malicious, or unauthorized activity performed through your device or account.

This provision does not apply to claims arising from Perito Urology’s own professional negligence, willful misconduct, or violation of law.

23. Governing Law and Venue

These Terms and disputes arising specifically from use of the Website are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, an action arising specifically from these Terms or use of the Website must be brought in a state or federal court with jurisdiction in Miami-Dade County, Florida.

This Website venue provision does not alter any separate law, agreement, or procedural rule applicable to a healthcare liability claim, insurance dispute, patient account, or other clinical matter.

24. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

25. No Waiver

A failure by Perito Urology to enforce a provision of these Terms does not waive the right to enforce that provision or another provision later.

26. Assignment

You may not assign your rights or obligations under these Terms without our prior written permission.

Perito Urology may assign these Terms as part of a merger, restructuring, sale, transfer of assets, or other lawful business transaction.

27. Entire Agreement

These Terms, together with the Privacy Policy and any other policies expressly incorporated into them, constitute the agreement between you and Perito Urology regarding use of the Website.

Separate patient, clinical, financial, consent, and service agreements remain independently enforceable according to their terms.

28. Changes to These Terms

We may revise these Terms periodically.

When changes are made, we will update the effective date at the top of this page. Material changes may also be communicated through the Website or by other appropriate means.

Changes apply prospectively from the stated effective date. Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms.
